Welcome to Bizstack ERP, a product of Rosix Technology Pvt Ltd. By accessing or using our platform, website, or services, you agree to be bound by the following Terms and Conditions. Please read them carefully before using our services.

1. Introduction

These Terms and Conditions govern the use of Bizstack CRM & ERP (“Software”, “Platform”, “Service”) operated by Rosix Technology Private Limited (“Company”, “We”, “Our”, “Us”).

By accessing or using the software, the customer (“Client”, “User”, “Subscriber”) agrees to comply with and be legally bound by these Terms.

2. Software Model

Bizstack CRM & ERP is provided as a Software-as-a-Service (SaaS) platform and is accessible through internet-based login access only.

The software is licensed, not sold.

Users are granted limited, non-transferable, non-exclusive access rights based on the subscribed plan and number of purchased users.

3. Free Trial

The Company may provide a free trial period of 7 days.

  • Trial access may include limited or full functionality at the Company’s discretion.
  • The Company reserves the right to modify or terminate the trial at any time without notice.
  • After completion of the trial period, continued use requires payment of applicable subscription charges.
  • Trial data may be deleted after expiration if no paid subscription is activated.

4.Subscription & User-Based Pricing

  • Subscription charges are based on the number of active users purchased by the Client.
  • Additional users require additional subscription fees.
  • Subscription fees are payable in advance unless otherwise agreed in writing.
  • All fees are non-refundable.

The Company reserves the right to revise pricing, plans, features, or billing structures at any time with prior notice.

5. Payment Terms

  • Failure to pay subscription fees may result in suspension or termination of access.
  • Delayed payments may attract additional charges or penalties.
  • Taxes, government duties, GST, VAT, or other applicable charges shall be borne by the Client.
  • Payments once made shall not be refunded under any circumstances.

6. User Responsibilities

The Client agrees:

  • To provide accurate information during registration.
  • To maintain confidentiality of login credentials.
  • Not to share accounts beyond purchased user limits.
  • Not to misuse, copy, reverse engineer, or attempt unauthorized access to the platform.
  • Not to upload unlawful, harmful, or malicious content.

7. Data & Security

  • In any case data loss, we are not responsible.
  • The Company maintains commercially reasonable security practices to protect data.
  • The Company is not liable for data loss caused by third-party services, internet failures, cyberattacks, user negligence, or force majeure events.
  • The Client is responsible for maintaining local backups if required only from given export option.
  • The Company shall not be responsible or liable for any unlawful, illegal, fraudulent, abusive, defamatory, government-restricted, or prohibited content, data, documents, communications, or activities uploaded, stored, shared, or managed by the Client through the software platform.

8. Availability & Support

The Company aims to provide uninterrupted service but does not guarantee continuous or error-free availability.

Scheduled maintenance, updates, technical issues, or third-party interruptions may temporarily affect access. We are not liable to pay any losses.

Support services are provided according to the subscribed plan.

9. Software Updates & Changes

The Company may:

  • Add, modify, or remove features at any time.
  • Release updates, patches, enhancements, or UI changes without prior approval or notice.
  • Restrict or discontinue any module, feature, or integration.

Continued use of the software constitutes acceptance of such changes. New modules will be chargeable.

10. Third-Party Integrations

The software may integrate with third-party services such as WhatsApp, Email Providers, APIs, Payment Gateways, Cloud Platforms, or External Applications.

The Company is not responsible for:

  • Third-party downtime or failures.
  • API limitations or policy changes.
  • External service interruptions.
  • Charges imposed by third-party providers.
  • For any data loss we are not responsible .

11. Intellectual Property

All software rights, source code, UI designs, branding, workflows, databases, logos, content, and technology remain the exclusive property of Rosix Technology Private Limited.

Clients shall not:

  • Copy or reproduce the software.
  • Resell or sublicense the platform.
  • External service interruptions.
  • Reverse engineer or modify the system .
  • Use the software for competitive product development .

Unauthorized use may result in legal action.

12. Limitation of Liability

To the maximum extent permitted by law:

  • The Company shall not be liable for indirect, incidental, special, or consequential damages.
  • The Company’s total liability shall not exceed the subscription fees paid by the Client during the previous three months.
  • The Company is not responsible for business losses, revenue loss, missed opportunities, or operational interruptions.

Use of the software is entirely at the Client’s own risk.

13. Suspension & Termination

The Company may suspend or terminate access without refund if:

  • Subscription fees remain unpaid .
  • Terms are violated .
  • Unauthorized usage is detected.
  • The software is used unlawfully or abusively

Upon termination, access to data and services may be restricted or deleted.

14. Confidentiality

Both parties agree to maintain confidentiality of non-public business information shared during the service relationship.

15. Force Majeure

The Company shall not be held liable for delays or failures caused by events beyond reasonable control, including:

  • Natural disasters.
  • Internet outages.
  • Government restrictions.
  • Cyberattacks.
  • Power failures.
  • War or civil disturbances.

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of courts located in Ahmedabad, Gujarat, India.

17. Modifications to Terms

he Company reserves the right to update or modify these Terms at any time.

We will not notify to you on new policy, terms or software updates, You can read on our website only.
